FALMOUTH STUDIOS TERMS AND CONDITIONS
Please read carefully; by confirming an order with us you are agreeing to our terms and conditions.
1. DEFINITIONS
“The Company” means FALMOUTH STUDIOS or (where the context so admits) any affiliated business.
“The Customer” means the person, firm, company, organisation or corporation purchasing the goods.
“Goods” means the garments, articles, embroidery work or services provided.
“Order” means the request made by the Customer for the supply of goods.
2. GENERAL
All estimates and orders are subject to these terms and conditions. No variation shall apply unless agreed in writing. All other conditions are excluded.
3. DESCRIPTION OF GOODS
All goods are sold subject to the availability of materials. Falmouth Studios reserves the right to substitute materials, threads, or garment styles where necessary. All descriptions, weights, and specifications are approximate and non-binding.
4. CATALOGUES & PROMOTIONAL MATERIAL
Brochures, price lists, and other promotional items are indicative only and do not form part of any contract. Prices are subject to change without notice.
5. PRICE VARIATION
Prices are based on current costs. Quotes may be amended to reflect changes in production or materials unless a fixed price has been agreed in writing.
6. ORDERS
We reserve the right to accept or refuse any order.
Orders must include all artwork, specifications, and sizing details to avoid delays or cost adjustments.
7. PRELIMINARY WORK
Work carried out at a customer’s request, including samples or mock-ups, will be charged accordingly.
8. ARTWORK & DIGITISATION
We charge a one-off fee for embroidery digitisation. Additional costs may apply if artwork is not provided in a suitable format.
9. PROOFS
Proofs may be submitted for approval. We are not liable for errors not corrected by the customer. Positioning can vary by up to 4cm due to garment inconsistencies. Please supply previous samples or measurements if exact replication is required.
10. SAMPLES
Samples are charged upfront but can be refunded or credited (see full policy below).
If samples are used in the final order, they will be deducted from the balance.
75% refunds apply to returned, unused samples within 2 weeks.
We advise ordering an embroidered sample or requesting approval photos for large orders.
11. EMBROIDERY FILES & MATERIALS
Embroidery files (stitch files) and other materials remain the property of Falmouth Studios unless provided by the customer.
Files may be deleted unless requested otherwise in writing.
12. CUSTOMER SUPPLIED ITEMS
Items supplied by the customer are at their own risk. We reserve the right to reject unsuitable garments. Spoilage should be accounted for when sending items. Falmouth Studios will not be held liable for imperfections due to garment quality or composition.
13. DELIVERY
Delivery dates are estimates only. We are not liable for delivery delays beyond our control.
Orders are deemed accepted upon delivery or notification of completion.
Extra delivery charges apply for alternative addresses or expedited services.
If the customer delays or suspends an order, additional fees may apply.
14. QUANTITY TOLERANCES
For orders over 1000 units, a 5% over/under tolerance applies and will be billed accordingly.
15. DAMAGES & SHORTAGES
Notify us of damaged or missing goods within 3 days of receipt. Claims outside this window may not be accepted.
16. RISK & OWNERSHIP
Risk passes on delivery, but ownership remains with Falmouth Studios until payment is made in full.
17. RETURNS
Returns are only accepted for genuine faults or where the product differs from the approved sample/proof.
Unembroidered garments are returnable within 28 days, subject to restocking fees (25%).
Certain products (e.g. suiting, hi-vis, underwear) are non-returnable.
All return requests must be made within 7 days of delivery.
18. PAYMENT
Unless otherwise agreed, payment is due at the end of the month following delivery.
Goods remain the property of Falmouth Studios until paid in full.
Directors of businesses agree to take personal liability if their company defaults on payment.
19. OVERDUE ACCOUNTS
Interest of 2% per month applies to overdue invoices. We reserve the right to refer debts to a collection agency.
20. PROPERTY RIGHTS
Falmouth Studios retains ownership of goods until full payment is received. Goods must be kept identifiable and separate until paid for.
21. UNLAWFUL MATERIAL
We reserve the right to reject any orders containing potentially illegal or infringing content. Customers indemnify us against related claims.
22. FORCE MAJEURE
We are not liable for delays caused by events beyond our control, including fire, strikes, or material shortages.
23. COLOUR VARIATION
Thread colours are matched as closely as possible to Pantones or supplied references but may vary depending on garment or thread.
We do not accept digital screen colour references—please supply physical samples or Pantone codes.
If not specified, we will use our best judgement.
24. PRODUCT IMAGES & SIZING
Images and sizes shown online or in catalogues are approximate and may vary slightly. We recommend ordering samples where accuracy is essential.
25. ONLINE ORDERS
Customers are responsible for their account credentials. All orders placed via the online portal are considered authorised.
26. EMBROIDERY QUALITY
Embroidery appearance can vary slightly between garments or batches. We recommend requesting samples where matching quality or appearance is critical.
